Welcome to POLSE. These comprehensive Terms of Service govern your use of our mobile application, website, and purchase of our products. Please read carefully before using our services or making a purchase.

1. Introduction & Acceptance

Welcome to POLSE ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mobile application, website, and services (the "Service") operated by POLSE.

By accessing or using our Service, downloading our mobile application, or purchasing our products, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service or purchase our products.

Acceptance of Terms: By downloading, installing, or using the POLSE app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Age Requirement: You must be 18 years or older to use our services and purchase our products. Users under 18 must have parental supervision when using our fitness equipment.

App Description & Features

POLSE is a fitness and wellness application that provides:

  • Access to pilates and fitness videos
  • Subscription-based premium content
  • Shopping for fitness-related products
  • User profile and progress tracking

Subscription Terms & Pricing

Subscription Options

  • Monthly Subscription: £17.99 per month
  • Annual Subscription: £99.99 per year

Auto-Renewal

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase

Payment

  • Payment will be charged to your iTunes Account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
  • Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal

Free Trial

  • No contractual free trial periods are currently offered
  • Any promotional free access periods may be offered at our discretion

Cancellation & Content Access

Cancellation Policy

  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
  • You may cancel your subscription at any time through your iTunes Account Settings
  • Cancellation takes effect at the end of the current billing cycle

Content Access After Cancellation

  • When your subscription ends, premium content will be placed behind a paywall
  • You will retain access to free content and basic app features
  • Previously downloaded content will not be accessible without an active subscription

Family Sharing

  • Apple Family Sharing is supported for subscriptions where available
  • Family sharing eligibility depends on Apple's policies and your iTunes Account settings

Apple-Specific Terms

License Terms

This application is licensed, not sold, to you by POLSE for use strictly in accordance with these terms and Apple's Usage Rules.

Third Party Beneficiary

Both you and POLSE acknowledge that these Terms are concluded between you and POLSE only, and not with Apple, and that Apple is not responsible for the Application or the content thereof.

You and POLSE acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

Orders & Delivery

Order Processing

  • All orders are subject to acceptance and availability
  • Order confirmation does not guarantee product availability
  • We reserve the right to refuse or cancel orders at our discretion

Drop Shipping & Delivery Times

  • Products are drop-shipped directly from our suppliers in China
  • Standard delivery times: 45-55 days for reformers, 2-4 weeks for accessories
  • Delivery times are estimates and may vary due to customs, weather, or unforeseen circumstances
  • We will provide tracking details once your order has been dispatched

Shipping Restrictions

  • We ship worldwide except to the United States
  • Additional customs duties or taxes may apply for international orders
  • It is your responsibility to provide accurate shipping details
  • POLSE is not liable for delays or failed deliveries caused by incorrect information provided by the customer

Pricing

  • All prices are displayed in British Pounds (GBP) unless otherwise stated
  • Prices include VAT where applicable for UK customers
  • Prices are subject to change without notice
  • Any promotional pricing is valid for the time period specified

Payment Methods

  • We accept major credit cards, PayPal, Apple Pay, and other payment methods as displayed at checkout
  • Payment is required in full at the time of order
  • Your payment information is processed securely through our payment partners

Currency & Billing

  • All transactions are processed in GBP
  • Your bank may apply currency conversion fees for international transactions
  • You are responsible for any additional bank or payment processing fees

Returns & Refunds

Digital Content

  • Subscription services and digital content are non-refundable except as required by law
  • Refunds for subscription services must be requested through the App Store

Physical Products - General Policy

  • Change of Mind: We do not offer refunds, exchanges, or returns for change-of-mind purchases
  • Please ensure you are confident in your purchase before placing an order
  • All sales are final unless the product arrives damaged or faulty

Damaged or Faulty Products

  • If your product arrives damaged or faulty, you are entitled to a replacement
  • Proof of damage (clear photos or videos) must be submitted within 3 days of receiving the item
  • Once damage is verified, a replacement will be shipped at no additional cost
  • In rare cases where a return is approved, the product must be unused and in its original packaging

International Returns

  • Return shipping costs for international orders may be the customer's responsibility
  • Customs duties paid on original shipment are non-refundable

  • Main Unit: 5-year warranty on frame and mechanical components
  • Accessories: 1-year replacement warranty on accessory parts (springs, straps, pulleys)
  • Warranty covers manufacturing defects and normal wear under proper use
  • Warranty does not cover damage from misuse, accidents, or failure to follow instructions

Quality Assurance

  • All reformers undergo quality checks before dispatch
  • We are committed to delivering products that meet our high standards
  • Our reformers are designed for home use and regular exercise routines
  • Proper care and maintenance will ensure optimal performance and longevity

Warranty Claims

  • Warranty claims must be submitted with proof of purchase
  • Photos or videos may be required to assess warranty claims
  • Replacement parts will be shipped at no charge for valid warranty claims

Safety & Usage Requirements

Safety Requirements

  • Age Requirement: Users must be 18 years or older, or supervised by an adult
  • Health Advisory: Consult a medical professional before starting any new fitness program
  • Weight Limit: Maximum user weight is 100kg - exceeding this limit voids warranty
  • Supervision: Do not workout unsupervised, especially when starting

Personal Responsibility

  • By purchasing and using our reformers, you acknowledge that exercise carries inherent risks
  • POLSE is not responsible for injuries, accidents, or harm caused by improper use or failure to follow instructions
  • Users exercise at their own risk and should listen to their body
  • Stop exercising immediately if you experience pain or discomfort

Proper Use Guidelines

  • Use only as intended for pilates and fitness exercises
  • Follow all safety instructions provided in videos and documentation
  • Ensure adequate space around the reformer during use
  • Regular maintenance and inspection of components is recommended

  • All content in the POLSE app, including videos, images, text, and audio, is owned by POLSE or our licensors

User License

  • We grant you a limited, non-exclusive, non-transferable license to access and use our content for personal fitness purposes
  • This license terminates when your subscription ends or is cancelled
  • You may not share your account credentials or access with others

Permitted Use

  • Content may be used for personal fitness and exercise purposes only
  • Recording, screenshotting, or sharing our content is prohibited
  • Commercial use of any POLSE content is strictly forbidden

User-Generated Content Policy

Reviews & Photos

  • You may submit reviews, photos, and feedback about our products and services
  • By submitting content, you grant POLSE a worldwide, royalty-free license to use, display, and distribute your content
  • Your content must be truthful, respectful, and not infringe on others' rights
  • We reserve the right to remove or modify user-generated content at our discretion

Prohibited Content

  • Content that is false, misleading, or defamatory
  • Content that violates intellectual property rights
  • Content that is offensive, inappropriate, or harmful
  • Spam, promotional content, or commercial messages

Content Moderation

Account Termination Policy

Termination by User

  • You may delete your account at any time through app settings
  • Subscription cancellations must be processed through the App Store
  • Account deletion does not automatically cancel active subscriptions

Termination by POLSE

  • We may suspend or terminate accounts for violation of these Terms
  • Termination may occur for fraudulent activity, abuse, or misuse of services
  • We will provide notice when possible, except in cases of serious violations

Effect of Termination

  • Terminated accounts lose access to all premium content and features
  • Personal data may be retained as required by law or for business purposes
  • Some data may be permanently deleted and cannot be recovered

Force Majeure & Limitation of Liability

Force Majeure

POLSE shall not be liable for any delays, failures, or disruptions to service delivery, product shipments, or performance resulting from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or acts of God
  • Government actions, regulations, or trade restrictions
  • Supplier delays, shipping disruptions, or customs delays
